    The data controller, 4IDentify, is a sole proprietorship with the company purpose, contact details, and representative.

    The processing of personal data by 4IDentify complies with Regulation (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

    The data collected will be used for the purpose for which they were collected and for which they have been authorized by the data subject. The data may also be used, with the express consent of the holders, for contacts with information related to the reason for processing the data.

    When filling out forms, the communication of your personal data is optional, free, and voluntary.

    However, on certain forms the information marked with an * is mandatory. Failure to provide information marked as mandatory will result in the impossibility of analyzing the information for the purposes of filling out the form and consequently the impossibility of providing the requested information or services since it makes communication unfeasible.

    In providing the services and offering products, 4IDentify processes various categories of personal data, of both Customer and non-Customer holders, and has classified them as follows:

    Civil identification data (vg. name, gender, date of birth, signature);

    Tax identification data (vg. tax identification number);

    Digital identification data (vg. IP address, geographic coordinates);

    Other identifying data (vg. father's name, mother's name, social media);

    Address and contact details (vg. tax address, mailing address);

    Professional and academic data (vg. profession, employer, income, public positions, ENI);

     4IDentify processes the personal data of any data subject under any of the following purposes:

    • Performing contracts entered into or performing pre-contractual diligence at the request of the Data Subject;
    • Compliance with legal obligations to which 4IDentify is obligated;
    • Pursuit of 4IDentify's legitimate interests ;
    • All other situations not included in the above mentioned purposes require the consent of the holder, which must be given freely, specifically, informed and unequivocally.

    To fulfill its duties and to provide a quality service, 4IDentify may need to communicate your personal data to other entities, including the following categories of recipients: Tax Authority, Service Providers providing services.

    When filling out and sending forms, in addition to the information requested in the form regarding name, email contact, and cell phone, the system records the IP, date, time, and communication service provider, browser, and equipment.

    The processing of data by 4IDentify will remain as long as necessary or mandatory for the fulfillment of the purposes indicated above. Upon termination of the contractual relationship, the personal data, the processing of personal data and their storage will remain for the mandatory legal time limits or until they expire, under the law, the rights arising therefrom.

    Under the terms of the applicable law, Customers, as the holders of data, are entitled to the following rights:

    Right of access: whenever you request it, you can access your personal data, obtain information related to the processing of your data, and also obtain a copy of your personal data being processed.
    Right of rectification: whenever you consider your personal data to be incomplete or incorrect, you may request that it be rectified or completed.
    Right to erasure: without prejudice to legal and regulatory obligations which may limit the exercise of this right, you may request the erasure of your personal data when one of the following situations arises: (i) the personal data are no longer necessary for the purpose for which they were collected or processed; (ii) you withdraw the consent on which the data processing is based and there is no other legal ground for it; (iii) you object to the processing of the data and there are no overriding legitimate interests, to be assessed on a case-by-case basis, that justifies the processing; (iv) the personal data must be erased under a legal obligation to which 4IDentify is subject; (v) the personal data have been unlawfully processed; or (vi) the personal data have been collected in connection with the provision of information society services. The right to erasure shall not apply where processing is necessary (i) for the exercise of freedom of expression and freedom of information; (ii) in order to comply with a legal obligation requiring such processing; (iii) for reasons of public interest in the area of public health; (iv) for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes to the extent that exercising the right to erasure would seriously prejudice the achievement of the purposes of such processing; or (v) for the establishment, exercise or defense of legal claims.
    Right to limitation of treatment: you may request to limit the processing of your personal data in the following cases: (i) if you challenge the accuracy of your personal data, for a period of time that allows you to verify its accuracy; (ii) if the treatment is illegal and opposes the deletion of the data, requesting, in return, the limitation of its use; (iii) if 4IDentify no longer needs personal data for processing purposes, but if that data is necessary for the purposes of declaring, exercising or defending a right in a judicial process; or (iv) if you have opposed the treatment until 4IDentify's legitimate interests are found to prevail over yours.
    Right to withdraw your consent: where the data processing is based on your consent, you may withdraw consent at any time. In this case, your personal data will no longer be processed, unless there is another ground that justifies such processing by 4IDentify.
    Right to lodge complaints with the CNPD: You have the right to lodge complaints regarding matters related to the processing of your personal data with the National Commission for Data Protection.
